Highlands Wilderness is a privately owned (sectional title) game/nature farm in the foothills of the Waterberg, 20Km North West of BelaBela. This vacant land is situated inside this game farm with rich animal and bird live. It provides a pleasant and harmonious environment and the farm gets managed and utilised by most owners. Highlands is not focussed on commercial activity. This ensures a community where a sense of ownership contributes to assuring harmonious relations. Highlands belongs to all the owners under sectional title agreement. Highlands currently manage the farm through an elected board of trustees which uses monthly levies paid by owners, to appoint labour and pay expenses. They foresee the filling of the vacant position of farm manager to take care of operational management. All the Trustees are non-paid volunteer owners. Highlands historically consisted of 2 farms which gives a combined area of some 13000Ha which is now registered as a single legal entity. If owners build a house, the “footprint” may not exceed 250square meters. Entry is controlled via a game fence of 2.1m and an access gate with 24 hour security. This stand is real right. What is a real right?
The original developer of Highlands Wilderness opened a sectional title register, allocated stands and sold certificates of Real Right which were subsequently registered at the deeds office. In our context the Real Right is also referred to as a “real right of extension” or a “development right”. The title holder of a Real Right certificate has the right to build on Highlands Wilderness subject to the conditions stipulated in that certificate and subject also to the Sectional Titles Act, the sectional title register for Highlands, our own rules and regulations and various other laws. A Real Right does not represent ownership of land but like other titles in immovable property can be transferred and mortgaged (Section 25(4) of the Act).The Act extends the definition of “developer” to include also the holder of a Real Right. Therefore anyone who builds a house on Highlands has effectively taken the place of the original developer and is thus responsible for the various formalities that go with building a house.
